Program Period: 13 October 2025 00:00 AWST to 19 December 2025 23:59 AWST
1. Overview
1.1 These Terms & Conditions (“Terms”) govern Panaclear Corporation Pty Ltd's (“Panaclear”, “we”, “us”, “our”) Buy One, Gift One promotion (the “Program”).
1.2 By making a qualifying purchase and/or submitting a gift claim, you agree to these Terms.
1.3 Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
2. Key Conditions (Summary)
When: 13 Oct 2025 00:00 AWST to 19 Dec 2025 23:59 AWST
Where: Australia only (purchaser and gift shipping addresses must be in Australia)
What you get: one (1) FREE Complexion Perfection Face Wash or Flawless Finish Spot Treatment per qualifying order (upgrades may be offered at additional cost)
Shipping: free standard shipping on gifts; Express available at extra charge
Cap: one (1) gift per qualifying order; max three (3) gifts per customer during the Program Period
Claim cut-off: submit gift claim by 19 Dec 2025 23:59 AWST
Stock: gifts subject to reasonable availability; if unavailable we’ll offer a comparable item (equal or greater value) or alternative selection at no extra cost

3. Eligibility & Qualifying Orders
3.1 New orders placed during the Program Period qualify, including:
One-time purchases; and
The first charge of new subscriptions started during the Program Period.
3.2 Existing subscriptions, subscriptions with an initial start date before the Program Period, are eligible only on the first recurring order processed within the Program Period.
3.3 Orders must be placed on panaclear.com.
3.4 Each qualifying order entitles you to claim one (1) gift. A single customer (based on reasonably linked identifiers such as name, email, payment method and/or shipping address) may claim a maximum of three (3) gifts during the Program Period.
3.5 The Program is available only where the customer and gift recipient’s shipping addresses are in Australia.
4. Gift Claim Process
4.1 After checkout of a qualifying order, we will provide a secure claim link via email.
4.2 To claim, you must submit: (a) your valid order number; (b) your friend’s name and Australian shipping address; (c) your selected gift item; and (d) your preferred shipping option (standard included; express optional and charged at checkout).
4.3 Claim cut-off: All claims must be submitted by 19 December 2025 23:59 AWST.
4.4 Claims are subject to validation (including order verification) and stock availability at time of fulfillment.
4.5 We may reasonably ask for additional information to verify eligibility.
5. Gift Items, Availability & Substitutions
5.1 Standard gift options: Complexion Perfection Face Wash or Flawless Finish Spot Treatment (one unit).
5.2 We may offer upgraded gift options at an additional charge (clearly disclosed at claim).
5.3 If a selected gift becomes unavailable despite reasonable planning, we will provide:
(a) a comparable item of equal or greater value at no additional cost; or
(b) the ability to reselect from available options; or
(c) a reasonable alternative remedy in accordance with the ACL.
5.4 Gifts are not for resale, have no cash alternative, and are not transferable.
6. Shipping, Delivery & Address Accuracy
6.1 Gift shipping is available to Australian addresses only.
6.2 Standard shipping for gifts is free. Express shipping is optional at the additional charge shown during claim.
6.3 Estimated delivery windows (shown during claim) are indicative and may vary by location and carrier performance, especially during peak periods.
6.4 Please ensure the recipient’s address and contact details are accurate and up to date. If your gift has not shipped, contact hello@panaclear.com as soon as possible to request an update; we will take reasonable steps to assist.
6.5 We are not responsible for delays or redelivery fees caused by incomplete or incorrect addresses or an unavailable recipient, except where required by the ACL.
7. Cancellations, Returns & Refunds
7.1 If your original qualifying order is cancelled or refunded in full before the gift ships, any unshipped gift will be cancelled.
7.2 Our 30-day money-back guarantee for first-time customers does not apply in conjunction with the Program. If you do not claim a gift, we will honour 30-day money-back guarantee claims. If you attempt to claim a gift on your order after claiming the 30-day money-back guarantee, we reserve the right to deny the gift claim.
7.3 Your consumer guarantees under the ACL continue to apply to your purchased Panaclear products and, where applicable, to gift items. If a gift is faulty or not as described, contact us and we will provide remedies required by the ACL.
7.4 Except as required by the ACL, we do not offer exchanges or credits for change of mind on gifts.
8. Fraud, Abuse & Fair Use
8.1 We may decline or cancel a gift claim if we reasonably suspect fraud, abuse, ineligibility, or breach of these Terms (for example, re-using the same order number, email, or address beyond the permitted cap, automated/bulk claims, or other manipulative conduct).
8.2 Any action we take under this Section will be fair and reasonable and will not limit your rights under the ACL.
9. Variations, Suspension & Program Closure
9.1 We may modify, suspend or end the Program prospectively (for future orders/claims) if required by law or due to factors beyond our reasonable control (e.g., supply constraints, carrier issues, systems outages).
9.2 Changes will not affect confirmed gift claims already accepted for fulfillment, except where reasonably necessary due to factors outside our control and in accordance with the ACL.
10. Privacy, Third-Party Details & Communications
10.1 When you submit a friend’s details to deliver the gift, you confirm you have their permission to share their information for that purpose.
10.2 We will collect, use and disclose the friend’s personal information only to administer and deliver the gift, to the extent reasonably necessary, and in line with our Privacy Policy.
10.3 Any marketing communications to the friend will only be sent if they provide consent (e.g., by ticking an opt-in box). All marketing messages will include a functional unsubscribe.
10.4 We may send transactional messages necessary to administer the gift (e.g., address confirmation, shipping notices) without marketing content.
10.5 You and the friend should review our Privacy Policy for more details, including data storage and contact information.
11. Communications & Spam Compliance
11.1 We comply with the Spam Act 2003 (Cth).
11.2 Marketing emails/SMS will only be sent to individuals who have provided the required consent, and will include a working unsubscribe facility.
11.3 Transactional messages (e.g., claim links, shipping updates) are used only to administer the Program and are not marketing.
12. Liability
12.1 To the maximum extent permitted by law, we are not liable for:
(a) delays or failures caused by carriers, public holidays, extreme weather, peak seasonal congestion, or events beyond our reasonable control;
(b) claims submitted with inaccurate or incomplete information; or
(c) indirect or consequential loss.
12.2 Nothing in these Terms limits liability that cannot be limited under the ACL.
13. General
13.1 No fees are charged for standard gift shipping; optional express charges are disclosed at claim.
13.2 The Program does not constitute a game of chance or lottery; no trade-promotion permits are required.
13.3 These Terms form part of, and should be read with, our Website Terms of Use, Returns Policy and Shipping Policy (to the extent applicable). In the event of inconsistency, these Terms apply to the Program.
13.4 If any provision is held invalid, the remaining provisions remain in full force.
13.5 These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
